Description

State revenue agents entered property rented by tax debtor John Bleavins and seized several trailers. Mr. Bleavins then filed a civil rights action in state court in which he alleged a violation of his rights under the Fourth Amendment. The defendants removed the case to the district court. The district court ruled for Mr. Bleavins on liability, and he received an award following trial on damages. The defendants appealed, and we reversed the district courts judgment. On remand, the district court determined that the defendants had not violated Mr. Bleavins Fourth Amendment rights and, in the alternative, that the defendants were entitled to qualified immunity. Mr. Bleavins appeals that determination. For the reasons set forth in the following opinion, we affirm the judgment of the district court.
